On August 19, 2022, the International Scientific and Practical Conference “Assessment and Compensation for Damage Caused by the Conduct of the Aggressive War by the russian federation against Ukraine” was held on the basis of the Kyiv Scientific Research Institute of Forensic Expertise of the Ministry of Justice of Ukraine. It was organized together with the Ukrainian Scientific and Research Institute of Special Equipment And Forensic Expertise of the Security Service of Ukraine, the Council of Advocates of the Kyiv Region and the Vadym Hetman Kyiv National Economic University of Ukraine”.
The event was held in a mixed format (live communication and online video conference).
The purpose of the event was to discuss topical issues of causing damage by aggressive actions of military formations of the russian federation. It is stipulated peculiarities of fixing war crimes, establishing a causal link between the guilty actions of the aggressor and the consequences in the form of damage caused, execution of court decisions in cases of compensation for damage caused by the aggressor country in Ukraine and foreign jurisdictions. It also underlined the role and importance of forensic examinations in identifying and determining property damage, caused by the aggressor.
Oleksandr Ruvin, Director of the Kyiv Scientific Research Institute of Forensic Expertise, Doctor of Law, Honored Lawyer of Ukraine, made the opening speeches at the conference. Andrii Svintsytskyi, Director of the Ukrainian Scientific and Research Institute of Special Equipment And Forensic Expertise of the Security Service of Ukraine, Candidate of juridical sciences, Honored Lawyer of Ukraine also addressed the audience as well as the representatives of the Bar Council of the Kyiv region.
The International Scientific and Practical Conference was attended by judges of the Criminal Court of Cassation, the Civil Court of Cassation within the Supreme Court, the Commercial Court of Cassation within the Supreme Court, law enforcement officers (prosecutor’s office, internal affairs), the Security Service of Ukraine, representatives of the Center for Special and Forensic Expertise of the Ukrainian Research Institute of Special Equipment and Forensic Expertise of the Security Service of Ukraine, experts of the Kyiv Scientific Research Institute of Forensic examinations, teachers of higher educational institutions, researchers, lawyers, practising lawyers.
Representatives of the Kyiv Scientific Research Institute of Forensic Expertise at this event were:
· Mykhailo Polennikov, Candidate of Economic Sciences, Leading Forensic Expert of the Laboratory of Economic Research of the Kyiv Scientific Research Institute of Forensic Expertise presented a report on the topic “The role and importance of forensic economic examination in documenting the amount of losses caused to business entities as a result of the armed aggression of the russian federation on the territory of Ukraine”;
· Oleksii Komandarov, Candidate of Technical Sciences, Honored Builder of Ukraine, Head of the Department for Research of Project Documentation and Cost of Construction Works of the Kyiv Scientific Research Institute of Forensic Expertise with the topic of the report “Practical aspects of determining the amount of material damage in case of destruction or damage to real estate”;
· Vasyl Matveiev, Chief Forensic Expert of the department of transport and commodity research of the laboratory of auto technical, commodity and special types of research with the report “Assessment of shipping facilities and damage caused as a result of armed aggression of the russian federation”.
During the discussions, the conference participants covered the economic and legal aspects of recovery of damage caused by the armed aggression of the russian federation against Ukraine. It also underlined expert support for identifying and determining the damage caused by the armed aggression of the russian federation against Ukraine and other topical issues regarding compensation for damage caused by the aggressive war of the russian federation against Ukraine.
Based on the results of the conference, a collection of abstracts will be published.
