The problem of drug crime in recent decades has acquired a catastrophic scale, and the number of crimes related to drug trafficking in Ukraine has been steadily increasing. To effectively counter drug smuggling and, in general, everything related to drug trafficking and its consequences for society, a comprehensive approach is needed: the interaction of expert institutions, government agencies, public and international organizations, etc.
In 2017, Ukraine joined the European Union’s international project “EU Action against Drugs and Organised Crime (EU ACT): Enhanced Cooperation and Capacity Building to address drug-related Organised Crime along the Heroin Route”.
Now, one of the positive results of the Working Group on the study of psychoactive substances: the project “EU Action against Drugs and Organised Crime (EU ACT): Enhanced Cooperation and Capacity Building to address drug-related Organised Crime along the Heroin Route” was the introduction of the order of the Ministry of Health of Ukraine “On certain issues of classification of drugs and substances to analogues of narcotic drugs and psychotropic substances”. The document provides for approval of the procedure for assigning drugs and substances to analogues of narcotic drugs and psychotropic substances.
The procedure establishes the mechanism for the assignment of drugs and substances to analogues of narcotic drugs and psychotropic substances and the preparation of conclusions on the affiliation of synthetic or natural substances (substances) whose chemical structure and properties are similar to the chemical structure and properties of narcotic drugs and psychotropic substances included in the List of narcotic drugs, psychotropic substances and precursors whose psychoactive action they reproduce.
According to the Head of the Materials, Substances and Products Research Department of Kyiv Scientific Research Institute of Forensic Expertise, the appropriate action was necessary and long-awaited:
“Every week, at least one new substance appears on the market, their total quantity becomes uncontrollable. According to uncontrolled, unclassified narcotic substances still remain. For the first time in the last 30 years, the term “analogues of narcotic drugs and psychotropic substances” has started to operate and this is definitely an achievement,” noted Oleh Posilskyi.
By this time, drug criminals who distributed new psychoactive substances that were not included in the list of controlled substances could not be prosecuted. Although in fact these new psychoactive substances are synthetic analogues of drugs and psychotropic drugs.
Today, after the discovery of new psychoactive substances in the illicit traffic, it will be much easier to establish state control over them. This is a very important step, it will significantly strengthen the position in the fight against drug trafficking.
