Experts of the Kyiv Scientific Research Institute of Forensic Expertise participated in the round table “Compensation for losses caused by military aggression of the russian federation: international cooperation of the legal and expert community”

On April 12, 2023, a round table “Compensation for losses caused by military aggression of the russian federation: international cooperation of the legal and expert community” was held.

The event was organized by the Kyiv Region Bar Council, the International Charitable Foundation “Ukrainian Renaissance – XXI”.

The purpose of the event was to conduct educational work on the qualitative collection of information, recording war crimes related to property damage and discussing possible ways to bring the aggressor to justice.

The representatives of the Kyiv Scientific Research Institute of Forensic Expertise at this event were Kateryna Proskura, Doctor of Economics, Professor, Auditor, Forensic Expert, Chief Researcher of the Economic Research Laboratory of the Kyiv Scientific Research Institute of Forensic Expertise of the Ministry of Justice of Ukraine and Mykhailo Poliennikov, Candidate of Economic Sciences, Leading Forensic Expert of the Economic Research Laboratory of the Kyiv Scientific Research Institute of Forensic Expertise.

Kateryna Proskura presented for consideration the participants the presentation “Documentation and fixation of lost property as a result of armed aggression of the russian federation”.

Among the speakers of the event were also Mykhailo Kocherov, Doctor of Law, Managing Partner of IDC Legal Services, attorney-at-law; Olena Potopalska, Managing Partner, CEO, Risks, Consulting, auditor of AC Crowe Ukraine; Yurii Tsymbal, Lawyer, member of the Committee on Interaction with the Military Administration, Law Enforcement Agencies and the Judiciary to ensure the protection of civilians in conditions of war.

The moderator of the round table was Yevheniia Vakulenko, Candidate of Economic Sciences, Associate Professor of the Department of Corporate Finance and Controlling, Deputy Chairman of the Scientific and Practical Council of the Kyiv Region Bar Council, Chairman of the Kyiv Region Bar Council Committee, Chairman of the International Charitable Foundation “Ukrainian Renaissance – XXI”, Lawyer, Auditor.

The participants of the round table discussed a number of topical issues, in particular:

Claim proceedings for compensation for damage caused by the aggressor. The peculiarity of the collective appeal and its jurisdiction.

Possible sources of compensation for losses caused by military aggression of the russian federation.

Lawsuit proceedings against property located in the occupied territory: problems with the subjectivity of determining the defendant.

The practice of determining the losses of enterprises caused as a result of armed aggression of the russian federation (material damage and lost profits).

Documentation and fixation of lost property as a result of armed aggression of the russian federation.

Such measures are primarily aimed at developing constructive positions on how Ukraine, together with international partners, will work to create a mechanism for the confiscation of russian assets that can be used to restore Ukraine.
