Experts of the Kyiv Scientific Research Institute of Forensic Expertise became participants in the conference on the assessment of damage and losses caused to enterprises, institutions and organizations as a result of russia’s armed aggression

On March 9, 2023, a conference was held to assess the damage and losses caused to enterprises, institutions and organizations as a result of russia’s armed aggression. The event was organized by the Ministry of Reintegration of the Temporarily Occupied Territories of Ukraine. Forensic experts of research institutions of the Ministry of Justice of Ukraine on relevant types of forensic examinations were invited to the conference. The event was held online.

Representatives of the Kyiv Scientific Research Institute of Forensic Expertise at the conference were:

  • Roman Pasko, Head of the Laboratory of Engineering and Technical Types of Research of the Kyiv Scientific Research Institute of Forensic Expertise, Deputy Head of the Section;
  • Mykhailo Poliennikov, Leading Forensic Expert of the Economic Research Laboratory of the Kyiv Scientific Research Institute of Forensic Expertise;
  • Oleksandr Sadchenko, Head of the Organization of Scientific, Methodological Activities, Regulatory Support and International Cooperation Laboratory of the Kyiv Scientific Research Institute of Forensic Expertise.

The conference was held in the format of panel discussions, where participants considered the most pressing issues faced by experts regarding the issues of damage and damage assessment. The experts focused their attention on the following topics:

  • Algorithm for recording damage and losses caused to enterprises, institutions and organizations as a result of armed aggression of the russian federation (basic scheme for documenting damage and losses; signs of admissibility of primary evidence of damage and damage; characteristics of the elements of the algorithm; an indicative set of documents for compensation for damage and the amount of losses caused to enterprises, institutions and organizations in certain areas);
  • The conclusion of the forensic expert as proper and admissible evidence in the process of compensation for damages and losses (the value of the forensic expert’s conclusion for the process of compensation for damages and the amount of damages; the procedure for obtaining the opinion of the forensic expert and the subjects of expert activity; requirements for the content of the conclusion of the forensic expert);
  • Algorithm for obtaining compensation for damage and losses caused to enterprises, institutions and organizations as a result of armed aggression of the russian federation (procedure for compensation for damage and amount of losses at the national level (in court and out of court); procedure for compensation for damage and amount of losses in international forensic institutions; mechanisms for the execution of court decisions of national courts on compensation for damage and losses in the territory of other states where the assets of  the russian federation may be located.

During the discussion, the conference participants discussed the economic and legal aspects of recovery of damage caused by the armed aggression of the russian federation against Ukraine, expert support for the detection and determination of damage and other pressing issues of today regarding compensation for damage and losses caused as a result of russia’s armed aggression.
