Which laws do NOT govern the review of appeals in the field of forensic examination?

The provisions of the Law of Ukraine “On Citizens’ Appeals” do not apply to the procedure for reviewing applications and complaints established by:

- criminal, civil, and labor legislation;
- the Code of Administrative Procedure and the Commercial Procedural Code;
- the Laws of Ukraine “On the Judiciary and the Status of Judges,” “On Enforcement Proceedings,” “On Prevention of Corruption,” and “On Administrative Procedure.”

According to the Instruction on the Appointment and Conduct of Forensic Examinations and Expert Studies (approved by Order of the Ministry of Justice of Ukraine No. 53/5 dated 08 October 1998, as amended and supplemented, hereinafter referred to as the “Instruction”), the time limit for conducting an expert examination must not exceed 90 calendar days.

However, due to the excessive workload of experts and the handling of high-profile cases, examinations at the Kyiv Scientific Research Institute of Forensic Expertise (KNDISE) are generally conducted within a period exceeding 90 days. In cases of significant workload (more than 10 examinations simultaneously), a longer reasonable period is established in accordance with the Instruction by written agreement with the client.

If the authority (or person) that appointed the examination (or engaged the expert) refuses to approve the proposed reasonable time limit for conducting the examination, the case materials shall be returned with a recommendation to appoint the examination to other entities authorized to perform forensic activities as defined in Article 7 of the Law of Ukraine “On Forensic Examination.”

If, within 30 calendar days from the date of sending the letter regarding approval of a longer time limit for conducting the examination, no response is received from the authority (or person) that appointed the examination (or engaged the expert), the proposed time limit shall be deemed approved.

According to the Order of the Ministry of Justice of Ukraine dated 06 February 2026 No. 322/5, the cost of one expert hour is 458.01 UAH.

The final cost is determined only after receiving the document appointing the examination and reviewing the objects of study.

No. An expert is obliged not to disclose any information without the permission of the court or the party that engaged them. Any information regarding the case may be provided only with the written consent of the client or the court. The expert is prohibited from communicating with participants in the proceedings outside the courtroom.

For a forensic examination: a procedural document (a court ruling or an investigator’s order) or a contract concluded based on a written request of a person in cases provided for by law.

For an expert study: a contract concluded on the basis of a written application from the client (a legal entity or an individual).
