A session of the Forensic Expertise Section of Intellectual Property Objects

Experts of KFI took part in the meeting of the Forensic Expertise Section of Intellectual Property Objects of the Scientific Advisory and Methodological Council of Forensic Expertise under the Ministry of Justice of Ukraine.

Participants from KFI were the following people: Inna Holova, the Head of the Department of Commodity Research and Research of Intellectual Property Objects of KFI (Deputy Head of the Section); Viktor Davydchenko, the leading forensic expert of Kropyvnytskyi Branch of KFI; Nataliia Klymova, the leading forensic expert of the Department of Commodity Research and Research of Intellectual Property Objects of KFI.

In addition to participants from research forensic institutions of the Ministry of Justice of Ukraine, the Section was also attended by Nataliia Tkachenko, the Head of the organizational and administrative support department of the forensic expert activity of the Department of forensic and bankruptcy affairs of the Ministry of Justice of Ukraine and Olha Stelmach, Deputy Head of the Legal and Regulatory Office of Justice-Related Legal Institutions – the Head of the Department of Normative-Legal and Scientific-Methodical Support of Forensic Expert Activities of the Department for Justice and National Security of the Ministry of Justice of Ukraine.

The Section considered the following questions:

  1. Discussion of R & D reports completed in 2017.
  2. Consideration of the state of implementation of R & D, which is executed in accordance with the thematic plan of R & D of the Ministry of Justice of Ukraine for 2018 year.
  3. Consideration of explanatory notes to the topics of R & D, which are planned to be included in the thematic plan of the R & D Research Center for Forensic Examination on Intellectual property of the Ministry of Justice of Ukraine for 2019.
  4. Consideration of disputed issues of expert practice and discussion of topical issues of forensic examination of intellectual property objects, etc.

The section heard from the leaders of the R & D, which are executed in accordance with the thematic plan of the Research Center for Forensic Examination on Intellectual property of the Ministry of Justice of Ukraine for 2018, reports on the state of implementation of the relevant research work:

  • “Development of methodological recommendations for calculation of labor intensity for the development of computer programs at the stage of early designing on the basis of the structural model of costs of СОСОМО ІІ”;
  • “Development of methodical recommendations on the use of software and hardware complexes (specialized software) to detect signs of plagiarism in literary, artistic and scientific works”;
  • “Development of a methodology for determining the market value of intellectual property objects”.

Concerning the explanatory notes to the topics of R & D, which are planned to be included in the thematic plan of the Research Center for Forensic Examination on Intellectual property of the Ministry of Justice of Ukraine for 2019, the Section considered the draft explanatory memorandum on the topic “Methodological recommendations “Peculiarities of conducting expert researches related to labels”, the implementation of which is envisaged for 2019-2020 year. Actually, all members of the Section, as well as invited representatives of the profile departments of the Ministry of Justice of Ukraine expressed their positions on this topic.

The issue of R & D is recognized as relevant and new, but requires clarification and correction, the study of relevant forensic activities, until the next session of the Section in autumn. The members of the Section and the invited people expressed their views on the optimization of the system of types of forensic examination on intellectual property issues. Other issues were also considered, in particular, regarding the organization of the Section session in autumn.

The Deputy Chair of the Section, Inna Holova (KFI), also stressed the importance of conducting an appropriate R & D for the development of forensic expertise on intellectual property issues, and proposed that an appropriate R & D be made, after clarifying it, by joint efforts of the Center and KFI. The Head of the Section, Vladyslav Fedorenko, supported this initiative, stressing that the collaboration with Research Center for Forensic Examination on Intellectual property has always yielded good results.

After the meeting of the section, the experts of KFI continued their work and became participants of the interdepartmental seminar “Forensic studies of literary works of a scientific nature: methodological issues” dedicated to the International Day of Intellectual Property.

The aim of the seminar was the approbation of the main provisions of the “Methodology for the study of literary works of a scientific nature” developed by the Research Center for Forensic Examination on Intellectual property in 2016-2017, and the study of the prospects, methods and forms of using software products to identify signs of improper borrowing from a scientific nature.

The participants of the seminar discussed the theoretical and methodological foundations of forensic studies of literary works of a scientific nature in Ukraine, the peculiarities of research of literary works of a scientific nature by forensic experts within the expert specialty 13.1.1., prospects, methods and forms of using software products to identify signs illegal borrowing in literary works of a scientific nature.
